1. First Notification of Claim

We will take all of the information regarding the accident circumstances and details of your injuries and immediately assess the validity of your case. You will be able to sign our terms over the phone and we will get things moving for you.

2. Instruct Medical Expert

A medical expert will be instructed to examine you within 4-6 weeks of the accident and will assess the extent of your injuries and provide a prognosis for your recovery. They will also recommend any necessary treatment.

3. Arrange Physio (if required)

If the medical expert recommends physio or other rehabilitation, we will negotiate approval with the other party’s insurer and facilitate this for you.

4. Medical Report Diagnosis

Once the medical report is received by our team, we will share this with you for approval and also assess the likely required actions. Sometimes this will involve further examinations or treatment depending on the extent of your injury.

5. Rehabilitation & Care Plan

Where injuries are more severe or require further medical intervention, we will ensure that you have access to the appropriate services whether that be medical, social or occupational and negotiate funding on your behalf with the responsible insurer.

6. Compensation Offer

Our expert team will value your personal injury and other damages claim and then seek your authority to proceed with negotiation. We will provide our advice to you and then pursue settlement of the claim on your behalf.

7. Settle Claim

Once we have agreed final settlement with the responsible insurer on your behalf, we will sign forms of authority with you and request settlement cheque on your behalf which will then be sent onto you.

8. Legal Proceedings

On occasions, it may not be possible for us to agree settlement with the other side on the terms we feel you are entitled to. In the event of this happening, we will issue legal proceedings acting on your behalf to recover your losses and damages.

We are well aware that the claims process can feel like a daunting task, with many unanswered question. We have created this section to answer some of those questions. Or alternatively contact us directly.

  • How do I make a claim?
    Call our claims notification team on 03300 240 709 and let us deal with the rest for you.  Your claim will be allocated to a dedicated individual with appropriate qualification and experience suited to the nature of your injuries.  You will be kept updated at every stage and given the appropriate advice to ensure the best possible settlement and a hassle free process.
  • What does liability mean?
    In simple terms this relates to who is responsible for the injuries sustained, sometimes referred to as "who was at fault for the accident?"  When establishing liability, you have to prove that
    • a duty of care was owed (all road users have a duty of care to other road users, pedestrians etc)
    • that the duty of care was breached and
    • that damage/injury was caused as a result of that breach.
  • What is the purpose of the medical examination?
    • The medical expert will assess your symptoms and will ask questions about your relevant medical history. The appointment will be similar to visiting your own GP. The expert will write a medico-legal report, which will assess your symptoms as well as any necessary treatment requirements and likely timescales for recovery from your injury.
    • We instruct the medical agency from an independent panel of experts, produced at random by MedCo. This is a legal requirement so we are not always able to choose the medical agency. During the instruction we enter your postcode to ensure that the appointment which is arranged for you is in your local area.
  • How quickly will the medical appointment be arranged?
    The medical agency will usually contact you directly by phone within one week of instruction. Instruction is usually done as soon as possible after you have agreed to our terms and conditions during your signup. The appointment will generally be arranged for 4-6 weeks after your accident. This is a standard timescale to allow the expert to fully assess you after some time has elapsed.
  • What if I have suffered with similar health problems before?
    Any relevant pre-existing medical conditions will be considered by the independent medical expert who will be instructed by us to provide a report on your injuries. The presence of a pre-existing injury will have no bearing on whether a claim can be pursued, however it is possible that the existence of such will affect the medical expert's opinion on how the much the accident has exasperated your condition or injury.  This will affect the assessment of the compensation the injury is likely to attract.
  • What other losses can I claim for aside from personal injury?
    This is by no means an exhaustive list and there will be limitations or requirements attached to some of these. We advise the client to complete their initial losses authority form (sent with terms and conditions) and return it to their file handler, along with receipts or photos, who may call to obtain further details or evidence.

  • How do I go about claiming for loss of earnings?
    If you are employed provide us with your employer's details and confirmation of the time you have had off work. If you are self-employed we will need copies of your accounts and tax returns. If it assists we can obtain these from your accountant.  
  • How long will my claim take to settle?
    It is difficult to provide an exact timescale without discussing your individual circumstances with you.  That being said, if liability is admitted by the other parties insurers and your claim is relatively straight forward, it can often be concluded within a few months.  More complicated injury claims, claims involving extensive periods of absence from work or claims involving a liability dispute, will likely take longer.  We will strive to conclude your claim as soon as possible however your claim will be dealt with thoroughly in order to make sure you get the best quality of service and settlement which is appropriate to your circumstances.
  • How do I find out what is happening with my claim?
    We pride ourselves on making sure that your dedicated case handler provides you with regular updates as your claim progresses and we can do that by e-mail or text to save time and keep you informed. However, we are always here to assist and you will be provided with the direct telephone number of your appointed handler so you can call them when you need to.
